USA announces clarifications on online study, OPT, transfers and study abroad

U.S. Citizenship and Immigration Services (USCIS) has announced some updates and clarifications on F/M student visas, including eligibility for STEM, online study, school transfers and study periods.

The new guidance clarifies that students may count one class or three credits per academic term towards a full course of study “if they take the class online or through distance learning not requiring physical attendance for any purpose integral to completion of the class”.

For transfers, the updated guidance states that international students on F-1 and M-1 visas may transfer between SEVP-certified schools at the same educational level or may move between educational levels.

The guidance clarifies that students may be eligible for post-completion Optional Practical Training (OPT) after completion of an associate’s bachelor’s, master’s or doctoral degree program.

USCIS also clarified that during the 60-day grace period following an authorized period of post-completion OPT, students may change their education level, transfer to another SEVP-certified school, or file an application or petition with USCIS to change to another non-immigrant or immigrant status.

There are also clarifications on international students taking study abroad programs while enrolled at a SEVP-certified school in the USA.

USCIS said that if the study abroad program is less than five months, the student will remain active in the Student and Exchange Visitor Information System (SEVIS). However, if the study abroad period lasts longer than five months, the student will need a new Form I-20, Certificate of Eligibility for Nonimmigrant Student Status when they return.
